for: Hvar’s private terrain owners community; Hvar’s climbing routes authors; Bolts makers

Warning: By Signing This You Are Waiving Your Legal Rights and You Give Up the Right to Sue

1. I, respectively my family members accompanied by me, or my minor children for which I am parent or otherwise responsible (next just I*, me* respectively) desire to enter and stay in private terrains with rock formations above, around Sveta Nedjelja village, specially in private terrain beneath Suplja Stina rock formation (next just private terrain*).

2. I waive any and all claims I may now and in the future have against, and release from all liability and agree not to sue property owners, authors of climbing routes, bolts makers, or other representatives, for any personal injury, death and property damages or expences which may suffer to me*, as result of staying or climbing in private terrain*.

3. I am fully aware that there are serious dangers and risks inherent in staying and climbing in private terrains*. I have full knowledge of the nature and extent of these risks and doing this I* may suffer personal injury, death or property loss. The particular of these injuries/death include, but are not limited to :

a) Any injury/death resulting from falling and impacting against the rock, the ground or the sea,

b) Any injury/death resulting from falling rocks

c) Any injury/death resulting from failure of roupes, slings, harnesses, climbing hardware, anchor points.

4. I acknowledge that the my/our enjoyment and excitement is derived in part from risk activities, like staying or climbing in private terrains* and that the inherent risks of these activities contribute to such enjoyment and excitement.

5. I acknowledge that it was adviced me* to use a helmet if staying or climbing in private terrains*. I acknowledge that the option not to wear a helmet exposes me* to increased risk.

6. I acknowledge that it was adviced me* to use all times minimally two independent bolts or anchor points, if rappeling down the rock formations around Sveta Nedjelja village, specially rappelling down the rock formation in Suplja Stina sector. I acknowledge that the option not to use minimally two bolts or anchor point if rappelling, exposes me* to increased risk.

7. I confirm that I have all times first aid kit with me if staying in private terrains*.

8. I confirm that I* have valid insurance for risk activity like climbing and staying in terrains with possible rocks falling, valid in Croatia, including possible rescue action.

9. I acknowledge that I* can be asked to stay out of private terrain* if I* do not have: helmet in use, due to point 5.; first aid kit, due to point 7.; valid insurance for risk activity, due to point 8., or not using minimally two independent bolts if rappelling due to point 6. of this form.

10. I confirm I am the full age of majority, or in the alternative, I have indicated that I am the parent or otherwise responsible person of the minor children named below

11. I am executing this Release and Waiver and Assumption freely and voluntary without any compulsions. I acknowledge that I have read this antire Agreement prior to signing it. I undrestand this even if my native language is not english. I agree that this agreement will be binding upon me, as participant or guardians, my heirs, next of kin, executors, administrators and assigns.
